TERRE HAUTE, Ind. (WTHI) - A man faces a felony charge for selling video games stolen from Sony DADC.
Terre Haute Police began their investigation into this on Friday.
This is a unique case.
We spoke with the Vigo County Prosecutor on why the man police arrested faces a felony charge of theft, which is usually a misdemeanor.
Misdemeanor theft s one of the charges Dshaye Towles faces.
He also faces a felony count of what's called "offense against intellectual property."
Police say Towles was selling video games stolen from DADC in Terre Haute that aren't even out yet.
He posted the games on eBay.
The game he was allegedly selling? Call of Duty World War II. It doesn't even come out until November.
He was arrested during a traffic stop near 8th and Ohio in Terre Haute.
Officials say he made only $45 per sale.
We asked the prosecutor why video games are considered intellectual property.
"People can't go out and create that same video game because it's considered a trade secret and the technology behind it, they've got patents, those kinds of things," Terry Modesitt said.
Sony DADC told police they have no record of Towles working for them.
Court documents don't say how Towles received copies of the unreleased game.
DADC officials believe Call of Duty World War II and Madden 18 were both stolen on the same day in early October.
Towles also has pending drug-related charges he will have to answer to next week when he returns to court.
